These Terms and Conditions govern your use of www.winfoxfootwear.com and any purchase you make from WinFox, a brand operated by DURGA TRADING CO, Plot No. 128-129, Phase VI, Sector 37, Gurugram, Haryana 122001, GSTIN 06BKVPK3616A1ZA. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.
1. Eligibility
You must be at least 18 years old and capable of entering a legally binding contract under the Indian Contract Act, 1872 to place an order. If you are under 18, a parent or guardian must place the order for you.
2. Your account
You are responsible for keeping your login details confidential and for all activity under your account. Please provide accurate name, phone and address details. We may suspend accounts that give false information or misuse the website.
3. Products and pricing
• We try to show product colours, materials and sizes accurately. Actual colours may vary slightly due to screen settings and lighting.
• Please check our size chart before ordering. Sizes follow UK/India sizing.
• All prices are in Indian Rupees (INR) and include GST unless stated otherwise. Shipping charges, if any, and the Cash on Delivery charge are shown at checkout before you pay.
• Prices and availability can change without notice. The price charged is the one shown when you place your order.
• If a product is listed at a clearly wrong price due to a technical or typing error, we may cancel the order and refund you in full.
4. Orders
Your order is an offer to buy. It is accepted when we dispatch it and send you a shipping confirmation. We may decline or cancel an order if the product is out of stock, the address is not serviceable, the order appears fraudulent, or there is a pricing error. If we cancel a prepaid order, we refund the full amount to your original payment method.
5. Payment
We accept UPI, debit and credit cards, net banking, wallets and Cash on Delivery (COD), processed securely through Razorpay. We do not store your card details.
A Cash on Delivery charge of Rs. 29 applies to every COD order and is added at checkout. Prepaid orders do not carry this charge. For COD orders, please keep the exact amount ready at delivery. We may limit COD by order value or pincode, and we may disable COD for customers who repeatedly refuse COD deliveries.
6. Shipping and delivery
We ship across India. Orders are usually dispatched within 24 hours of being placed and delivered within 3-4 business days, depending on your location. Delivery timelines are estimates and may be delayed by courier issues, weather or other events beyond our control. Please check the package when you receive it. If the outer package is visibly damaged or tampered with, refuse delivery or record an unboxing video and contact us.
7. Cancellations
You can cancel an order free of charge before it is dispatched by contacting support@winfoxfootwear.com or +91 81307 91452. Once dispatched, the order cannot be cancelled, but you may return it under our Return, Refund and Exchange Policy.
8. Returns, refunds and exchanges
Returns, refunds and exchanges are governed by our Return, Refund and Exchange Policy, which forms part of these terms.
9. Intellectual property
All content on this website, including the WinFox name and logo, product designs, photos, text and graphics, belongs to DURGA TRADING CO or its licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
10. Acceptable use
You agree not to:
• Use the website for any unlawful or fraudulent purpose.
• Place fake orders or misuse offers, discount codes or the COD option.
• Attempt to hack, disrupt or overload the website.
• Post false, abusive or defamatory reviews or content.
11. Offers and discount codes
Offers and codes are subject to their own terms, are valid for a limited time, and cannot be exchanged for cash. Unless stated, only one code can be used per order. We may withdraw an offer or cancel orders that misuse it.
12. Limitation of liability
We provide the website on an "as is" basis. To the extent permitted by law, WinFox is not liable for indirect or consequential losses arising from your use of the website or products. Our total liability for any order will not exceed the amount you paid for that order. Nothing in these terms limits your rights as a consumer under the Consumer Protection Act, 2019.
13. Indemnity
You agree to indemnify WinFox against any claims or losses caused by your breach of these terms or misuse of the website.
14. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, government action or courier disruptions.
15. Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute amicably through our Grievance Officer. If unresolved, the courts at Gurugram, Haryana will have exclusive jurisdiction, without affecting your right to approach a consumer commission under the Consumer Protection Act, 2019.
16. Changes to these terms
We may update these terms from time to time. The version on this page when you place an order applies to that order.
